No, because its theft of intellectual property and services.
In fact, SOE shut down Project 1999 at one point for this very reason. They are operating from a location that does not care, and are not in accordance with the law in most nations (although pursuit of players for this is very low to nonexistent.)
Once EQ servers actually shut down, there is effectively a timer before something like this could be done, unless the company that owns the property (Daybreak, at this point, it seems) renews paperwork to keep it from going to the public domain (becoming 'Abandonware.')
So, technically, playing P99 is likely not legal. The use of services which are themselves in violation of the law is not usually something that people get in trouble for, but the real question is whether you are okay with using those services. I'd say it isn't something that really stands up as being ethically sound... but you are free to make your own judgment.

I need to stop playing this anyway. My bedtime is usually 11PM. Last night, I was up to 1:40 doing a corpse recovery from Crushbone. I started at 9 PM at level 12 and I had a level 14 bard to show for all that grind and frustration.
When I was young(er) and stupid(er) I had a life that could do that. I am trying to put the finishing touches on my novel and raise a daughter. I am not the graduate student I was in 1999.
Corpse runs and exp loss for dieing are some things I do not miss

Indeed. I just remembered talking about this because when the OP opened the post it was an unofficial thing which Sony had filed against, so letting those who might enjoy it know it is now okay... sounded reasonable.
